Supplementary Protection Certificates

You have come to the right place for advice on  Supplementary Protection Certificates (SPCs).

Dr Gordon Wright and Dr Oliver Kingsbury have extensive experience in advising on SPCs. Gordon and Oliver both come from a pharma background.  Gordon joined Elkington and Fife from Sanofi and Oliver from Pfizer.

Gordon has been a dominant player in SPCs since the first SPC Regulation came into effect in January 1993. In May 1993, he was responsible for the first third party observations to be filed during the application phase of an SPC and in 2009, he was the first to file third party observations in a case before the High Court, Astellas Pharma’s SPC Application [2009] EWHC 1916 (Pat). Other leading SPC cases include Takeda’s SPC Applications [2004] RPC 1, [2004] RPC 3, [2004] RPC 2.  Gordon and Oliver have advised most of the world’s leading pharmaceutical companies in relation to SPCs and patent term extensions and have coordinated SPCs filings across Europe for several applicants.  They have lectured and written widely on the subject.

With their knowledge and understanding of the needs of pharmaceutical industry and the nature of pharmaceutical products, Gordon and Oliver offer unrivalled expertise for anyone wishing to get the most out of their SPC applications, or to obtain advice on other aspects of SPCs.
